Guarantor and Guarantee of Unpaid Rents

There are rules on combining different types of guarantees, in particular between a guarantor (surety) and the guarantee for unpaid rent (GLI).

1 . Civil lease
This concerns rentals where the accommodation is not the tenant's main residence.
In this case, the owner can combine the guarantor and the GLI, regardless of her status, whether she is a private individual or a professional entity, and regardless of the status of the tenant (student or not).

2. Leases subject to the law of July 89
These are classic unfurnished leases (3 years tacitly renewable), furnished leases (1 year tacitly renewable), student leases (9 months) and mobility leases (1 to 10 months).

2a. Private individual owner or similar (e.g.: SCI)
The lessor cannot combine the guarantor and the GLI except in the case of a student or apprentice tenant.

2b. Professional owner - legal entity
The owner cannot combine the guarantor and the GLI except in the case of a student tenant (except for scholarship holders).
